Terms of Service

1. The agreement

Benjy is operated by Roomfilla Pte Ltd, a company registered in Singapore at 160 Robinson Road, Singapore. By accessing or using Benjy you accept these Terms and our Privacy Policy. If you're using Benjy for an organisation, you confirm you're authorised to accept these terms on its behalf. If you don't agree, don't use Benjy.

2. The service

Benjy lets you create, host, gate, embed, and measure interactive and shoppable video — including branching video, video quizzes, shoppable feeds, and access-controlled "secure" video. We may add, change, or remove features over time.

3. Eligibility and accounts

You must be at least 18 and able to form a binding contract. You're responsible for your account, for keeping your credentials secure, and for activity under your account. Tell us promptly at hello@heybenjy.com if you suspect unauthorised use.

4. Plans, billing, and refunds

• Subscriptions — paid plans are billed in advance on a recurring basis until cancelled. You can cancel anytime; cancellation takes effect at the end of the current billing period.
• Lifetime deals — if you bought Benjy through a marketplace lifetime deal (such as AppSumo), the marketplace's terms and refund window also apply, alongside these Terms and any deal-specific limits (for example usage tiers).
• Money-back guarantee — where we offer a money-back guarantee on a subscription, it applies as described at the point of sale.
• Taxes — prices may exclude taxes, which you're responsible for where applicable.

5. Your content

You keep all ownership of the videos, images, text, and other materials you upload or create ("Your Content"). You grant us a worldwide, non-exclusive licence to host, store, process, transcode, reproduce, and display Your Content only as needed to provide and deliver the service to you and the viewers you choose — and for no other purpose.

You are responsible for having the rights to Your Content. You confirm that you own it or have all necessary licences, permissions, and releases — including for any people who appear in it, any music or third-party footage, and any content sourced from other platforms (for example a clip originally posted to social media). You must not upload content you don't have the right to use commercially, and you're responsible for any endorsement disclosures required by law when you feature others' content or testimonials.

6. Acceptable use

You agree not to use Benjy to:

• upload or share content that is illegal, infringing, defamatory, deceptive, or that violates someone's privacy or intellectual property;
• upload content that is hateful, harassing, sexually exploitative, or that depicts or promotes serious harm;
• break the law, including consumer-protection, advertising, and data-protection law;
• attempt to breach security, access other accounts' data, scrape, overload, or reverse-engineer the service;
• resell or sublicense Benjy except as expressly permitted.

We may remove content or suspend accounts that breach these terms, and will cooperate with valid legal requests.

7. Privacy, viewers, and your responsibilities

When you collect data from your viewers using Benjy (for example by email-gating a video), you are the data controller for that data and we are your processor, as described in our Privacy Policy. You must have a lawful basis, obtain valid consent where required, give your viewers your own privacy notice, and honour their data requests. You must not use captured leads in a way that breaks the law or your promises to those viewers.

8. Third-party services

Benjy integrates with third parties such as Shopify and Google. Your use of those services is governed by their terms, and we're not responsible for them. You're responsible for your own accounts and credentials with them.

9. Our intellectual property

Benjy, including its software, design, brand, and content we create, is owned by us and our licensors and protected by law. We grant you a limited, non-exclusive, non-transferable right to use Benjy per these terms. You may not copy, modify, or create derivative works of the platform itself. Any feedback you give us, we may use freely.

10. Availability, beta features, and changes

We work to keep Benjy available but don't guarantee uninterrupted service. Some features may be offered as beta or early access and may change or be withdrawn. We may modify the service and these terms; for material changes we'll give reasonable notice, and continued use means acceptance.

11. Disclaimers

To the extent permitted by law, Benjy is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We don't warrant that the service will be error-free or meet every requirement.

12. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to these terms is limited to the amount you paid us for Benjy in the 12 months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or fraud).

13. Indemnification

You agree to indemnify and hold us harmless from claims, losses, and costs arising from Your Content, your use of Benjy, or your breach of these terms or of any law or third-party right.

14. Suspension and termination

You can stop using Benjy and close your account at any time. We may suspend or terminate access if you breach these terms, fail to pay, or to protect the service or others. On termination, your right to use Benjy ends; we may delete Your Content after a reasonable period, so keep your own copies. Terms that should survive termination (such as ownership, disclaimers, and liability) will.

15. Governing law

These terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction, without affecting any mandatory consumer rights you have where you live.
